Smart Circumstance In Spotlight As Kidnapper Stands Trial
Brian David Mitchell will face charges of kidnapping within the Elizabeth Smart case after years of avoiding them. The Elizabeth Smart kidnapping had been a media sideshow in 2002 and jury selection for Mitchell’s trial went ahead Monday. Mitchell’s lawyers plan to argue the man is ridiculous, although that did not work for his wife, who was convicted this past year and might testify against him. What occurred when Elizabeth Smart had been kidnapped
June 5, 2002 was when Elizabeth Smart had been kidnapped. The teenager’s abduction and eventual rescue was a never-ending news story and her parents became media fixtures as they repeatedly pleaded for her safe return. Nine months later she was found just 18 miles from her home with Mitchell, a drifter who had done some repair work at the Smart residence, and his wife, Wanda Ileen Barzee. Mitchell, who believed he was a prophet named “Emmanuel,” had been charged along with his wife with kidnapping, sexual assault and burglary. The Utah district court ruled in July 2005 on the couple. They were said to be incompetent to stand trial by the court.

Elizabeth Smart’s case brought on a TV movie and book to be made about this. This caused Mitchell and Barzee to be ruled competent to withstand trial again in 2008. In November 2009 Barzee pleaded guilty to kidnapping and unlawful transportation of a minor. She ended up getting a prison sentence of 15 years. Barzee said she’d cooperate in state and federal cases against Mitchell in a plea agreement. In Dec 2009 a nurse observing Mitchell in a psychiatric ward said he had been faking insane behavior to stay away from prosecution. In March 2010, Mitchell had been told by U.S. District Judge Dale Kimball that he would stand court. The judge called him a “misleading psychopath” also.

Elizabeth Smart, who is 22 now, testified at Mitchell’s competency listening to. She said that through the nine months she had been kept by Mitchell, he sexually assaulted her many times when also taking her at knife point from her room. In 2002, a ton of media covered the story of what happened. This is what Mitchell’s attorney’s used to say that no impartial jurors would be found. Mitchell was dressed as a prisoner Monday when he went to the federal courthouse in salt Lake City instead of as a patient. 35 potential jurors followed him in.
